1. About these Terms
These Terms apply when you visit the SafeLink Kids website, create or use a Guardian account, activate or use a SafeLink product or service, or buy goods or services from us. Please read them together with our Privacy & POPIA Notice and any product, plan, delivery or returns information presented to you before checkout.
The supplier is Juchepi Group (Pty) Ltd, registration number 2024/476642/07, trading as SafeLink Kids (“SafeLink”, “we”, “us” or “our”). We are a South African private company with registered office at 76 De Waal Street, Brackendowns, Alberton, Gauteng, 1448, South Africa. You can contact us at info@safelinkkids.co.za. SafeLink Kids Sales: 061 677 2045 / 0608518931.
Juchepi Group is not currently registered for VAT. We do not charge VAT separately or issue VAT invoices.
2. Important service limitation
SafeLink provides safety technology and protected communication to help a Finder contact an authorised Guardian. Where expressly included in the selected service, Operations Support may assist with communication, coordination and appropriate external escalation, subject to availability. The features included in your purchase are those described in the applicable product or plan information.
SafeLink is not a security company and does not provide security services, guarding, armed response or emergency response. This applies to all SafeLink products, Protection plans and Operations Support. The names “Protection” and “Operations Support” describe SafeLink’s communication and coordination offering; they do not mean that SafeLink supplies a security or emergency-response service.
SafeLink is not SAPS, an emergency medical service or a dispatch centre, and does not replace those services or a contracted private security provider. SafeLink does not provide continuous GPS tracking and does not guarantee that a person or property will be found, recovered or protected, that a Guardian or external service will respond, or that the service will always be available. If anyone is in immediate danger, contact the appropriate emergency service directly.
3. Definitions
- Guardian means an adult account holder authorised to manage a SafeLink product and receive communications relating to it. It is a SafeLink account role and does not by itself establish legal guardianship.
- Finder means a person who scans or taps a SafeLink identifier and uses the available SafeLink communication process.
- SafeLink product means an approved QR, NFC or other SafeLink identifier and any associated physical item.
- Protection service means the paid or included SafeLink service associated with a product or plan.
- Operations Support means support made available by SafeLink for communication, coordination or appropriate external escalation where the applicable plan includes it.
- Guardian information means the account and contact information supplied by or for an authorised Guardian.
4. Eligibility and Guardian accounts
You must be at least 18 years old and legally capable of entering into an agreement to create a Guardian account or place an order. You must provide accurate, current and authorised information, keep your contact details updated, protect your sign-in credentials and promptly tell us if you suspect unauthorised account access.
You are responsible for ensuring that you are authorised to activate and manage each SafeLink product linked to your account. Use a private product label, such as “Blue Band” or “School Bag Tag”, rather than unnecessary identity, school, address, medical or other sensitive information.
5. Multi-Guardian access
Where Multi-Guardian functionality is available, an authorised Guardian may invite or authorise another eligible adult. Each Guardian must use their own account. The inviting or primary Guardian must ensure that an invitation is appropriate and may manage access using the controls made available by SafeLink. Multi-Guardian access does not change legal guardianship or other legal authority.
6. Products, orders and activation
Product descriptions, material features, prices, billing frequency, delivery charges and the order total displayed at checkout form part of your order. You must review and correct the order before payment. An order is accepted when we send an order confirmation or otherwise expressly confirm acceptance. We may decline or cancel an order where payment fails, stock is unavailable, information is materially incorrect, fraud is reasonably suspected or the transaction cannot lawfully be completed. If we cancel after receiving payment, we will refund the affected amount using the original payment method where reasonably possible.
A physical SafeLink product may require activation and an active Guardian account before associated services work. Ownership of a physical product does not create a guarantee of uninterrupted network, device, third-party or Operations Support availability.
7. Prices, payment and billing
All amounts are stated in South African rand unless clearly indicated otherwise. The price and billing frequency shown in your order summary at the time you confirm the transaction apply to that order.
Optional SafeLink Protection plans are available on a monthly or annual basis:
- Individual — monthly: R10 per month
- Individual — annual: R120 per year
- Family, covering up to 6: R50 per month
- Family, covering up to 6: R600 per year
The payment and renewal method shown before you place the order applies. Where renewal is by invoice, the invoice must be paid using an available payment method to renew the paid service. Any automatic recurring collection applies only where it is expressly offered and you separately authorise the disclosed amount and frequency. If payment fails or remains outstanding, we may ask you to complete payment, restrict the affected paid service after reasonable notice, or end that plan. We will not alter a recurring price without the notice and renewed agreement required by applicable law.
8. Delivery
We deliver using PUDO or PostNet to areas served by those providers. Available delivery methods, charges and the expected delivery period must be shown before checkout. We aim both to dispatch the order and complete delivery within 5 to 7 days after accepting the order and confirming payment. This is a delivery target rather than a guarantee because delivery can be affected by the selected provider, destination and circumstances outside our reasonable control. We will notify you if we become aware of a material delay.
Collection can be arranged by appointment from 76 De Waal Street, Brackendowns, Alberton, Gauteng, 1448, South Africa. Do not arrive for collection until SafeLink has confirmed the appointment and that the order is ready.
You must provide complete and accurate delivery or collection information. If a parcel cannot be delivered because the supplied information is incorrect or nobody accepts it, we may require payment of a reasonable additional delivery charge before sending it again. If delivery is materially delayed, unavailable or unsuccessful for another reason, contact us so that we can investigate and provide the remedy required by applicable consumer law.
9. Cancellations, returns and refunds
You may cancel or return an order where the Consumer Protection Act, the Electronic Communications and Transactions Act or another applicable law gives you that right. Nothing in these Terms limits any non-excludable cooling-off, cancellation, return, repair, replacement or refund right.
To request a subscription cancellation, send the same written request to both info@juchepigroup.com and info@safelinkkids.co.za. For a product return or refund, contact info@safelinkkids.co.za. Include your order or account details and the reason for the request. We may ask for information reasonably needed to verify and process it. Approved refunds will ordinarily be made to the original payment method.
In addition to any rights provided by law, you may notify us within 7 days after receiving a physical product that you have changed your mind. The product must be returned to 76 De Waal Street, Brackendowns, Alberton, Gauteng, 1448, South Africa using the return process we provide. Unless the return results from a defect, an incorrect item or another circumstance for which SafeLink is responsible under applicable law, you are responsible for the return-delivery cost. The product should be returned complete and in substantially the condition in which it was received, subject to any right to inspect it.
After we receive and inspect an eligible return, you may choose a replacement or refund where this policy or applicable law permits. We aim to process an approved refund within 7 days after receiving the returned product. Your bank or payment provider may take additional time to reflect it.
For a monthly subscription, cancellation stops future renewal. Our cancellation period is 30 days measured from the most recent payment date. Any service already paid for remains available through the paid-through date shown in your account. We will confirm the effective cancellation date, subject to applicable law.
If you cancel an annual subscription and request a refund, we will refund the value of the complete unused months remaining after the effective cancellation date. The refund is calculated by dividing the annual subscription fee by 12 and multiplying that amount by the number of complete unused months. A partly used month and the portion attributable to service already supplied are not refundable, except where applicable law requires otherwise. We will confirm the effective cancellation date and calculation in writing.
10. Defective or unsuitable goods
SafeLink provides a 3-month limited warranty against manufacturing defects in its silicone bands, pet tags and bag tags. The warranty period starts on the date the product is delivered or collected. Contact us with the order details and a description or photographs of the apparent defect. We may require the product to be returned so that we can inspect and assess it.
This additional warranty does not cover ordinary wear and tear, loss, theft, accidental damage, misuse, unauthorised modification, deliberate or malicious damage, or damage caused by use contrary to reasonable product instructions. If the product has a covered manufacturing defect, SafeLink will offer a replacement or refund.
If a physical product is defective, unsafe, materially differs from its description or is otherwise covered by a statutory consumer remedy, contact us promptly. We will provide the repair, replacement, refund or other remedy required by applicable law. The 3-month additional warranty and voluntary 7-day return policy do not reduce or replace any statutory consumer right.
11. SafeLink communication and location features
A Finder may be able to start a protected communication session after scanning or tapping a SafeLink identifier. Guardian telephone numbers and email addresses are not intended to be displayed publicly through that process. A Finder’s or Guardian’s location is shared only through the available consent-based action. Maps and location information can be inaccurate, delayed or unavailable and must not be relied on as the sole basis for an emergency decision.
Operations Support may access information where authorised and reasonably necessary for service delivery, safety handling, incident management, legal compliance or evidence preservation, subject to role controls and applicable policy. SafeLink may create incident or evidence records and apply a legal or evidence hold where reasonably necessary.
12. Privacy and personal information
We process personal information as described in the current Privacy & POPIA Notice. This may include Guardian account and order information, product identifiers and private labels, Finder session and technical information, communications, consent-based location, access records, incident information and payment-related transaction references. Payment-card details may be processed directly by an authorised payment provider rather than stored by SafeLink.
Do not submit unnecessary personal information about a child or any other person. Where you provide another person’s information, you must be authorised to do so. Retention, deletion, incident preservation and legal holds are governed by the Privacy & POPIA Notice and applicable law.
13. Acceptable use
You may not use SafeLink to break the law; impersonate or harass anyone; threaten, exploit or endanger a child or another person; transmit abusive, deceptive or malicious material; expose another person’s private information without authority; interfere with security or service operation; probe or bypass access controls; introduce harmful code; automate abusive traffic; or use a SafeLink identifier or account without authority.
We may restrict, suspend, preserve evidence from or terminate access where reasonably necessary to protect users, investigate misuse, comply with law or protect the service. Where appropriate and lawful, we will give notice and a reasonable opportunity to remedy the issue.
14. Third-party services
SafeLink may depend on hosting, connectivity, mapping, messaging, courier, payment and other third-party services. Their availability and separate terms may affect your use. A link or integration does not mean that SafeLink controls or guarantees the third party. We remain responsible for our obligations that cannot lawfully be transferred or excluded.
15. Service availability and changes
We aim to provide the service with reasonable care but do not promise uninterrupted, error-free or universally available operation. Planned maintenance, connectivity failures, device limitations, misuse, external events or third-party failures may interrupt service. We may make reasonable operational or security changes, but will not materially reduce a paid service during its current paid period without an appropriate remedy where required by law.
16. Intellectual property
Intellectual property in SafeLink’s software, branding, designs and original content belongs to Juchepi Group (Pty) Ltd or its licensors. Your purchase gives you the right to use the product and applicable service for their intended lawful purpose; it does not transfer ownership of that intellectual property. You may not copy, modify, reverse engineer or commercially exploit protected material without permission, except as permitted by applicable law or an applicable third-party licence.
17. Responsibility and liability
Each party remains responsible for loss caused by its breach, negligence or unlawful conduct to the extent determined under applicable law. SafeLink is not liable for loss caused solely by inaccurate information supplied by a user, unauthorised use, failure to follow reasonable instructions, a third-party network or service beyond our reasonable control, or use of SafeLink as a substitute for emergency or professional assistance.
To the fullest extent permitted by law, SafeLink is not liable for indirect or consequential loss that was not reasonably foreseeable when the agreement was concluded. Nothing in these Terms excludes or limits liability, a warranty, a remedy or another right where doing so is prohibited by the Consumer Protection Act or other applicable law, including liability that cannot lawfully be excluded for gross negligence.
18. Suspension and ending service
You may stop using the service and may cancel a paid plan using the process disclosed for that plan. We may suspend or end access for material or repeated breach, non-payment, fraud, unlawful or dangerous use, security risk, or where continuing the service is unlawful or no longer reasonably possible. Ending service does not erase information that must lawfully or reasonably be retained for transactions, incidents, disputes, security, evidence or legal holds.
19. Changes to these Terms and acceptance records
The version and effective date appear at the top of these Terms. They apply to transactions and acceptances from that date. They do not retrospectively replace the terms of an earlier transaction. We may update these Terms to reflect legal, operational or product changes. If a change materially affects an existing paid service, we will give reasonable notice and obtain renewed acceptance where required.
Please read the applicable Terms and review your order, price and billing frequency before accepting a purchase. We retain acceptance and transaction records. You may save or print these Terms and request the Terms version associated with your transaction by contacting us.
20. Complaints and disputes
Please send a complaint to info@safelinkkids.co.za or info@juchepigroup.com with enough detail for us to investigate. We will acknowledge and address it within a reasonable period. You retain the right to use any complaint, ombud, regulator, tribunal or court process available under applicable law.
These Terms are governed by the laws of the Republic of South Africa. Any dispute may be brought before a South African court with jurisdiction, subject to any consumer right to use another competent forum.
21. General
If a provision is unlawful or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision immediately is not a waiver. These Terms, the order confirmation, the applicable plan or product information and the Privacy & POPIA Notice form the agreement relating to the relevant transaction or service. If they conflict, mandatory law prevails, followed by the specific order terms and then these Terms, unless clearly stated otherwise.
